1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of koncyber.com (the “Site”), operated by KONCYBER Inc. (“KONCYBER,” “we,” “us,” or “our”), an Ontario, Canada-based cybersecurity advisory, incident response, and education firm. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site.
2. About This Website
The Site is provided for general informational purposes — to describe KONCYBER's services, share perspective through the Insights section, and provide a way to get in touch. The Site and its content are provided on an “as is” basis, as described further in Section 9.
3. General Guidance, Not Professional Advice
Information and opinions on this Site, including anything published under Insights, are provided for general guidance only. Because appropriate advice depends on your specific circumstances, KONCYBER recommends seeking direct professional consultation before acting on anything found on this Site. Use of this content is at your own discretion and risk. While we aim for accuracy, we are not responsible for inaccuracies or inconsistencies that may occur, including in contributed or third-party content.
4. Engagements Are Governed Separately
Browsing this Site, submitting a contact form, or subscribing to the newsletter does not create a client, advisory, or fiduciary relationship with KONCYBER, and does not create a duty of confidentiality beyond what applicable privacy law already requires (see our Privacy Policy). Actual advisory, incident response, exercise, training, or private-client engagements are governed by a separate, signed engagement agreement between you (or your organization) and KONCYBER, which takes precedence over this Site's content in the event of any conflict.
5. Intellectual Property
The Site and its content — including text, graphics, the KONCYBER name and logo, and layout — are owned by KONCYBER or its licensors and protected by copyright, trademark, and other applicable laws. You may view and share pages of this Site for personal, non-commercial reference. You may not sell, license, sublicense, modify, reproduce, publicly perform, distribute, or create derivative works from the content, or use it for any commercial purpose, without KONCYBER's prior written consent.
6. Acceptable Use
When using this Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to interfere with, disrupt, or place an unreasonable load on the Site's infrastructure.
- Attempt to reverse-engineer, scrape at scale, or probe the Site's security.
- Impersonate KONCYBER, Kenrick Bagnall, or any other person in connection with the Site.
- Frame or mirror any part of the Site without our prior written consent.
Given KONCYBER's work, we take attempts to probe or interfere with this Site's security particularly seriously and reserve the right to report unlawful activity to appropriate authorities.
7. Third-Party Links
This Site may link to third-party websites (for example, LinkedIn or media coverage) for convenience. KONCYBER does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party site. Visiting a linked site is at your own risk and subject to that site's own terms.
8. Submissions Through This Website
Standard web forms — including the contact form and newsletter signup — are not a secure channel for highly sensitive material. Please do not submit passwords, full financial account numbers, government identification numbers, privileged legal material, or malware samples through any form on this Site; see Section 15 of our Privacy Policy for the full list. You are responsible for the accuracy of information you submit, and for ensuring you have the right to share any information you provide about a third party.
9. No Warranties
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. KONCYBER does not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. You are responsible for maintaining your own systems and for any equipment or software needed to access the Site.
10. Limitation of Liability
To the fullest extent permitted by applicable law, KONCYBER and its principals, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, or data, arising out of or related to your use of, or inability to use, this Site — even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable Ontario or Canadian law.
11. Indemnification
You agree to indemnify and hold KONCYBER, its principals, employees, and contractors harmless from any claims, losses, or damages, including reasonable legal fees, arising from your misuse of the Site or violation of these Terms.
12. Not an Emergency or Law-Enforcement Channel
This Site, including the contact form, is not monitored 24/7 and is not an emergency, legal, or law-enforcement channel. KONCYBER is not a forensic laboratory, law firm, or law-enforcement agency. If you are experiencing an active incident requiring immediate assistance, or are in immediate danger, contact the appropriate emergency services or your organization's incident-response provider directly rather than relying on this Site.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Ontario.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site after a change is posted constitutes acceptance of the updated Terms.
15. Severability and General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. KONCYBER's failure to enforce any provision is not a waiver of that provision or any other. These Terms, together with our Privacy Policy, constitute the entire agreement between you and KONCYBER regarding use of this Site.
